By accessing and using School Path ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

We reserve the right to modify these terms at any time. Your continued use of the Service after such changes constitutes your acceptance of the new terms.

2. Description of Service

School Path provides a platform to help Texas families:

• Determine eligibility for the Texas Education Freedom Account (TEFA) program

• Understand document requirements

• Access educational resources and school choice information

• Receive personalized recommendations

We are not a government agency and do not make official TEFA eligibility decisions. Our eligibility assessments are for informational purposes only.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information

• Keep your login information secure

• Notify us immediately of any unauthorized access

• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. TEFA Eligibility

Our service provides a preliminary eligibility assessment based on information you provide. This assessment:

• Is not an official TEFA eligibility determination

• Does not guarantee approval for TEFA funds

• Is subject to verification by TEFA program authorities

• May change based on program updates

Final eligibility is determined solely by the Texas Education Agency and authorized entities.

5. Privacy and Data Protection

Your privacy is important to us. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

6. User Content

You retain ownership of content you upload (documents, personal information). By uploading content, you grant us a limited license to:

• Store and process your content

• Use your content to provide the Service

• Analyze aggregated data to improve the Service

You represent that you have the right to upload all content you provide.

7. Prohibited Conduct

You agree not to:

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOL PATH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

Our total liability shall not exceed the amount you paid to access the Service in the past 12 months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold School Path harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service

• Your violation of these terms

• Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the Service immediately, without notice, for any reason, including violation of these terms.

You may stop using the Service at any time. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.

Any disputes arising from these terms or the Service shall be subject to the exclusive jurisdiction of courts located in Texas.

14. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall continue in full force.

16. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and School Path regarding the Service.
